Betreff: Abgestellte/abgelegte Leih-Fahrräder
 

Sehr geehrte Frau Vizebürgermeisterin,

nachdem uns als Mieterbeirat schon mehrere Beschwerden zu unzumutbar und unkorrekt abgestellten bzw. abgelegten Leih-Fahrrädern aus unserer Wohnhausanlage erreicht haben, bin ich gestern um 18:19 Uhr nach Hause gekommen und fand folgende Situation vor: Ein Leih-Fahrrad lag etwa Ecke Nikischgasse/Lautensackgasse auf dem Gehsteig (das liegt anscheinend schon länger in diesem Bereich). Zwei weitere Fahrräder lagen keine 50 Gehsteig-Meter weiter im Durchgang zum Innenhof Nikischgasse 6. Heute (bei Regen und daher wenig Chance auf Nutzung und daher Entfernung) liegt ein solches Rad halb auf dem Gehsteig, halb in der Wiese unserer Wohnhausanlage vor dem Haus Nikischgasse 6, also innerhalb dieser Strecke von nicht einmal 50 Metern. Ob es sich um eines der drei genannten Räder handelt oder wieder ein anderes, ist für uns nicht feststellbar. Jedenfalls liegt es wieder woanders. Bei meinem Anruf gestern auf der via OFO-Homepage angegebenen Telefonnummer war niemand erreichbar - und es konnte keine Nachricht hinterlassen werden, weil die Mailbox voll ist. Anzunehmender Weise mit schon zahlreichen "Nettigkeiten" bezüglich der Art und Weise, wie hier vorgegangen wird.

Den Medienberichten entnimmt man eine "Beobachtungsphase in Wien" bzw. dass man "gegen die China-Bikes völlig hilflos sei". 

Für uns jedenfalls ist die "Beobachtungszeit" längst vorbei! Und wir fühlen uns nicht völlig hilflos - selbst wenn der Beamte gestern am Polizeinotruf die Polizei für unzuständig erklärt und gemeint hat, man möge sich an das Rathaus wenden, das diesen Betrieb schließlich genehmigt hat.

Wir haben nicht nur Blinde und stark Sehbehinderte bei uns in der Wohnhausanlage, die dadurch in Gefahr geraten, sondern auch Rollstuhlfahrer, Benutzer von Rollatoren, Kinderwägen und so weiter, denen dadurch die Nutzung der Gehwege in unzumutbarer Weise erschwert bzw. verunmöglicht wird.

Es gibt eine Straßenverkehrsordnung, die in  § 68 (4) zwar mittlerweile für solche Nutzungen unzureichend, aber doch auch gegebene Regelungen vorsieht. Und es gibt auch die Möglichkeit, seitens des Vermieters (Stadt Wien - Wiener Wohnen) mittels Besitzstörungsklage gegen die den ordentlichen Gebrauch durch die Mieter behindernde gewerbliche Nutzung jener Flächen vorzugehen, für deren Erhaltung und Betrieb die Mieter mittels ihrer Mietenzahlung aufkommen. Es gibt auch die Möglichkeit, unvorschriftsmäßig - daher behindernd bzw. sogar gefährdend abgestellte bzw. abgelegte Fahrräder durch die MA 48 für den Besitzer kostenpflichtig abschleppen zu lassen.

 

 

Bitte um umgehende Nachricht, welche Maßnahmen durch wen gegen das rasant anschwellende Übel ergriffen werden!

Dear Mr. Kuchta,
First of all I would like to thank you for your valuable information. And please forgive me to reply your email in English because I do not want you to wait and this would be the first hand reply from the ofo worker. My name is Liya Sun and I work in ofo AUT GmbH now.
1) As the worker from ofo, I could guarantee that before tomorrow afternoon, the illegally parked bikes will be properly handled. Actually in Vienna, we have an operation team, which has more than several workers from Austria, UK, Spain and China. They go around the district almost everyday to help the users to properly park the bikes, to handle the complains, to collect the broken bikes to one specific location, and then our truck will deliver all the broken bikes together to the warehouse. In the warehouse, we have mechanicians to help repairing the bikes. In Beijing, we have several IT groups to help develop the app, to collect the feedbacks from the users in Vienna, to design and try to optimise the user experience. For our own workers, besides the ofo app, we have also one work station to show the location of the reported broken, illegally parking, inactive and good bikes. From my point of view, no matter the company or our colleagues, we are trying our best to provide the best bike sharing service in Vienna. I would not judge something without even knowing what it is and how it works.
2) As one person living in Vienna and loves Vienna, I understand all your concern and appreciate greatly the developed and organised style of the city. But considering the situation you mentioned, I would be more concerned about how to guide people to properly use the bikes. And I believe that action speaks louder than word. It is always easier to simply complain than to provide the useful suggestions, to insist and to make things better. Personally, I would suggest instead of just denying it, have a look at how it works and give as much suggestion as you can.

Dear Mrs. Sun,

unneeded to mention, that normally it would be a pre-contition and basic requirement for every company to communicate in the native language of the country in which You offer Your services. Just for once I will accept English for the urgency-reasons You mentioned and try also to answer in English as effectively as possible.

Of course I know that China has a giant-sized population. But it would be necessary to transfer an enormous number of people to Vienna an place one person at least on every street corner twenty-four-seven to roughly to prevent problems caused by Your "services" and customers to all other people. Or do You really think, a wheelchair user for example will stop in front of one of Your bikes, call Your service line and then stay put until one of Your workers will have put away the damn nuisance? You are kidding, aren't You? 

Sorry, I was wrong, not anywhere near that the worker on every street corner would be enough! What about a blind or visually handicapped person tripping up on one of Your bikes? Who has to accept responsibility for the results? Your customer? Or Your company because of the awareness, that Ofo doesn't have everything under control?  

 

Of course I have read the content of Your German homepage (unfortunately empty this weekend completely and empty partly still now). So I have notice of the theory. And I can see clearly the results in the field - or rather in the lawn, on the pavement, in the passages etc.!

The citizens of Vienna are NOT Your employees who have to make phone calls or app-transactions to minimize problems YOUR business is generating. We are also NOT called upon to organize YOUR business/services so that the legal framework is observed and the daily life of the Viennes is unaffected. It is also NOT our business, how to guide people to properly use YOUR bikes. It is YOUR business. People very slowly change their behaviour - especially in an intended direction. That also has to be considered in Your business. If it is not, we have problems. And we are unwilling to accept that - especially in a so rapidly increasing dimension!
